A federal court in Norfolk, Virginia is scheduled to hear arguments this Tuesday in the case aimed at overturning Virginia’s same-sex marriage ban.  Old Dominion University Professor Timothy Bostic and real estate agent Tony London are suing Norfolk Circuit court after they were denied a marriage license. Also, parties to the lawsuit are Chesterfield couple Mary Townley and Carol Schall.

Code of Virginia on same-sex marriage:

§ 20-45.3. Civil unions between persons of same sex.

A civil union, partnership contract or other arrangement between persons of the same sex purporting to bestow the privileges or obligations of marriage is prohibited. Any such civil union, partnership contract or other arrangement entered into by persons of the same sex in another state or jurisdiction shall be void in all respects in Virginia and any contractual rights created thereby shall be void and unenforceable.

State Attorney General Mark Herring says he will not support the same-sex marriage ban in Virginia because it violates our U.S. Constitution, 14th Amendment and it is demeaning to same-sex couples.
