The custody fight between Halle Berry and ex-boyfriend Gabriel Aubry over daughter Nahla is still going strong, Us Magazine reports. Berry made an appearance in family court on Tuesday and accused Aubry of violating an April custody agreement regarding their 3-year-old daughter.

Laura Wasser, Berry’s heavyweight attorney, submitted lengthy documentation focusing on Aubry’s parenting skills. Halle alleges that Aubry neglected his daughter during an overseas visit and put her safety at risk.

Berry, 44, requested the judge rule that Aubry violated the agreement. Since he was not in court, the judge set a hearing for a later date.

“Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her,” her publicist said at the time. “Halle has always made the needs and safety of her daughter her first priority, both while Halle and Gabriel were a couple and since their break-up, Halle has only acted in her daughter’s best interest,” the publicist added.

Gabriel, 34, vehemently denies Halle’s allegations.

“Gabriel refuses to air their issues in the press as he believes this may ultimately harm their daughter,” his manager said. “The fact is that Gabriel is a caring father who shares custody of Nahla.”

Halle Berry and Gabriel Aubry ended their relatonship last April, and everything appeared to have been amicable. The first sign of trouble came when Aubry filed for joint custody of their daughter in January.
