A federal appeals court on Wednesday has reaffirmed its previous ruling declaring that the Federal Communications Commission improperly fined CBS for televising the pop star’s star-spangled nipple during the 2004 Super Bowl Halftime Show.

Sorry, Jackson haters.

The 3rd U.S. Court of Appeals in Philadelphia made today’s declaration after the Supreme Court sent the case back to the lower court in 2009, and its 2-to-1 decision wasn’t much changed since issuing its first opinion back in July 2008.

The panel still believes the FCC unfairly punished the network when it levied a $550,000 fine, because the regulatory agency failed to inform CBS about a change in its indecency enforcement rules. Specifically, the judges ruled that while the FCC can crack down on indecent images such as Jackson’s exposed breast—even if it was flashed onscreen for less than a second—the commission still acted arbitrarily by altering its policy after the fact and not informing the network.

The FCC released a statement expressing disappointment with the ruling.

“We are pleased that the court did not question the FCC’s statutory responsibility to regulate indecent broadcasting,” said the agency. “While we are disappointed by the Court of Appeals’ decision, we note that the court overturned the FCC’s 2006 forfeiture order on narrow procedural grounds. In the meantime, the FCC will continue to use all of the authority at its disposal to ensure that the nation’s broadcasters fulfill the public interest responsibilities that accompany their use of the public airwaves.”

No word whether regulators will appeal.

The FCC slapped CBS with the $550,000 penalty in September 2004 and the network’s first appeal was denied in February 2005. The commission subsequently rejected a second appeal in May 2006, arguing that CBS planned the chesty stunt deliberately. However, the 3rd Court of Appeals eventually threw out the fine.

While Drew Brees is getting a lot of attention after winning the Super Bowl and has done the traditional Disney World commercial, New Orleans Saints defensive captain, Jonathan Vilma, has other plans.

Vilma told reporters that he would go to Haiti after the Super Bowl to help out in earthquake relief. Here’s what he said Vilma said before the Super Bowl.

I want to go down there and help, whether it be to clear out the devastation, try to help build homes, whatever it is I want to go down and not just look around and say it’s a sad situation. We all know it’s a sad situation. What can I do to help the situation?

I’m hearing that Chris Brown “was all over” Keri Hilson at the Axe Lounge at Liv, where Diddy was hosting a bash and where Kim Kardashian and Reggie Bush were celebrating the Saints’ Super Bowl win.

According to E! News the two were “grinding each other” on the dance floor, and Chris even made a special request…

Hosting a Super Bowl Party this year? If so, offer your football fans plenty of good food to munch on while cheering for their favorite team.

Superbowl Sunday is not the time to think about your diet, this is the one day that we throw caution to the wind. Whether you tune in for the game, the halftime show, or the commercials, you won’t miss one minute of the action if you keep things simple with make-ahead dishes and easy buffets.

Here are some easy recipes to serve your guests:

Hooters’s Buffalo Wings

Prep. Time: 1:45

1 cup all-purpose flour
1 tsp. salt
1/2 tsp. paprika
1/2 tsp. garlic powder
1/2 tsp. cayenne pepper
1/4 tsp. black pepper
20 chicken wing segments
1/2 cup butter OR margarine
1/2 cup hot sauce (see Notes, below)

-In a shallow dish, combine flour, salt, paprika, garlic powder, and peppers.
-Coat chicken entirely in the flour mixture; refrigerate coated wings for 1 hour; coat chicken again with remaining flour mixture.
-In a 2-quart saucepan, heat butter and hot sauce just until butter melts; turn heat to low and keep warm on stove top.
-Deep-fry chicken, 8 – 10 pieces at a time, in 375 degree oil (vegetable oil, canola oil, or peanut oil) for 13 minutes, turning once or twice.
-Drain chicken on a wire cooling rack for 30 seconds, then immediately toss fried chicken in buffalo sauce mixture and remove with a slotted spoon.
-Repeat with remaining chicken.

Adjusting the spiciness of the sauce: As is, the recipe produces a medium sauce. To change the amount of spiciness, simply adjust the butter-to-hot sauce-ratio:
Mild: Use 3/4 cup butter and 1/4 cup hot sauce.
Hot: Use 1/4 cup butter and 3/4 cup hot sauce.

(I use this recipe every Superbowl Sunday and my guests always ask for more.)
