A fellow music exec/rapper has filed suit against the hip hop mogul Sean “Diddy” Combs for a 2010 incident at his Atlanta eatery.

The lawsuit alleges the veteran hip hop mogul failed to maintain a safe environment at his Justin’s restaurant in Atlanta.

Music executive Tony Austin, says he was shot in the establishment’s parking lot last September, according to the Associated Press.

Austin, former A&R for Def Jam and President of Russell Simmons Music Group, says he was in his car listening to music with another man when someone opened fire on the vehicle. The two men were rushed to the hospital where they were treated for multiple gunshot wounds.

Austin alleges that the proprietors of Justin’s were aware of “dangerous and hazardous conditions” at the establishment, but failed to provide sufficient warning or security protection.

Diddy founded Justin’s, named after his first-born son, in 1997 in New York. The Atlanta branch opened the following year.
